En octubre 2025, Xiamen MAKE Technology Co., Ltd. (en adelante referida como MAKE) demandó a Ningbo XX Lock Industry Co., Ltd. (en adelante referida como Ningbo XX) y a Cixi XX Industrial Co., Ltd. (en adelante referida como Cixi XX) por infracción de patente.
La razón fue que una cerradura con contraseña producida y vendida por Ningbo XX infringía gravemente una patente de modelo de utilidad propiedad de MAKE. Dado que Cixi XX y Ningbo XX comparten un único accionista y pueden ser responsables conjuntamente, MAKE solicitó legalmente una compensación por las pérdidas económicas a ambas empresas.

En febrero 5, 2015, MAKE applied to the State Intellectual Property Office for a utility model patent titled “A Password Lock Structure That Allows for Easy Password Recovery,” which was granted on September 2, 2015, with patent number ZL201520081730.9.
This patented product is the MK708. When a user forgets the password, they can retrieve it using a master key. This is simpler and more convenient than the traditional “probe + master key” password retrieval method.
The specific operation is:
Insert the master key to position and unlock.
Turn the dials from top to bottom until couldn’t be moved on.
Find the forgotten codes seccessfully.
The court reviewed and determined that MAKE legally holds this patent, and the patent right is legal and valid and should be protected by law. La solución técnica utilizada en la cerradura de contraseña de Ningbo XX se encuentra dentro del alcance de protección de la patente de modelo de utilidad de MAKE. Además, en diciembre 2024, sin el permiso de MAKE, Ningbo XX fabricó, vendió, y ofreció en venta el producto que infringía los derechos de patente de MAKE, constituyendo una infracción de patente según la ley de patentes.
Por lo tanto, MAKE tiene derecho a una compensación civil.
Resultado del caso
Ningbo XX debe asumir la responsabilidad civil por la infracción de los derechos de patente de MAKE. Cixi XX no logró proporcionar pruebas que demuestren que sus activos son independientes de los de Ningbo XX y debe asumir responsabilidad solidaria.
